Welcome to Beginly Health! We want you to know and understand your rights and our rights relating to the provision of our services (as defined below). Please review these Terms of Service carefully.
The Beginly Health website, related mobile application and all other Beginly Health-branded services are made available to you by Beginly, Inc. whose registered address is 434 NE Knott St, Suite 201, Portland, OR 97212, USA, subject to these Terms of Service and in accordance with our Privacy Policy. By using our services you agree to comply with our Terms of Service. We reserve the right to review user activity on our platform to monitor compliance with our terms.
The provision of Beginly Health's services and the execution of the agreement outlined in these Terms of Service are contingent upon the processing of data about you and other Beginly Health users. Processing the data you share is integral to the services we offer and is a crucial aspect of fulfilling our agreement with you.
We may update these terms from time to time. Your continued use of the service after any changes indicates your acceptance of the new terms.
User Accounts
You undertake that any and all information you upload and share using our services is truthful to the best of your knowledge. You also undertake that you will promptly correct any information in your user profile or your organisation, location or job descriptions that is inaccurate or has become outdated. Beginly Health exists to provide job seekers and recruiters with positive experiences based on the mutual suitability of our matches, and therefore we do not accept any form of misrepresentation by our users.
Your user account is for your sole use, and you will not share your password with anyone else. You are solely responsible for any content posted or shared from your account on our services. We reserve the right to remove any content that violates our community guidelines. We also reserve the right to suspend or terminate user accounts that we find have breached our Terms of Service.
You can register for or log in to your account using a third-party service like LinkedIn or Google. By choosing this option, you grant Beginly Health permission to use this data to register you and to log you into your account. If you link your account to a third-party network, you are bound to adhere to the terms, conditions, and policies governing that third party.
As Beginly Health's services use the Google Maps API, you agree to comply with the Google Maps/Google Earth Additional Terms of Service.
Community Guidelines
You understand that you are solely responsible for the content that you upload and share using Beginly Health's services. You are expected to adhere to our standards of professionalism and respect in everything you upload, including messages, pictures, documents and any other form of information. Beginly Health will not tolerate any content that is hateful, discriminatory, harassing, racist, violent, indecent, exploitative, abusive, offensive or in any way objectionable as deemed by us. We encourage all users to report any content they believe contravenes these guidelines to abuse@beginlyhealth.com so that we can take appropriate action.
Some of our services enable you to mark information as private, such as the ability to rate job opportunities or to message recruiters anonymously. Beginly Health will always take all possible steps to ensure that information you indicate as confidential using our service's features remains confidential. You agree to respect the confidentiality of other users of the service. You agree to remove the information relating to another user obtained from the Beginly Health service from your records should that user request that you do so.
Rights to the Service
You understand and consent that the software, services, and content provided by or as part of Beginly Health's services include confidential and proprietary information protected by intellectual property and other laws. Unless expressly allowed by applicable law or authorized by Beginly Health, you must refrain from altering, renting, leasing, loaning, selling, distributing, or creating derivative works based on the services or our software, either in whole or in part.
Termination
You may delete your user account at any time. We will delete your account and its associated data as described in our Privacy Policy.
Recruiter users access our services as part of their organization's agreement with us. Deletion of one or more recruiter accounts will not be deemed as cancellation of you organization's agreement with us. The terms of termination of your organization's agreement with Beginly Health are described in your contractual terms.
Feedback
We welcome feedback from our users and will give careful consideration to suggestions that our user community provide to us. If you provide us with feedback, you accept that we may use your feedback as part of our product development process for the benefit of our user community and that this will not create any ownership or intellectual property rights for you. You also agree that we may publish your feedback and accredit it to you by name unless you request that your name be redacted from the content we publish.
Limitation of Liability
You agree that you will not hold Beginly Health liable for any damages resulting from your use of our service, including but not limited to direct, indirect, incidental, or consequential damages.
Assignment
Neither party may assign or transfer this Agreement, or any rights or obligations hereunder, without the prior written consent of the other party. Notwithstanding the foregoing, either party may assign this Agreement, together with all rights and obligations hereunder, without the consent of the other party, in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of such party's assets. If the assignee is a direct competitor of the other party, the other party may terminate this Agreement upon thirty (30) days' prior written notice. Any attempted assignment in violation of this Section shall be void and of no effect. This Agreement shall be binding upon and inure to the benefit of the parties and their respective successors and permitted assigns.
Individual user accounts are personal to the account holder and may not be assigned, transferred, or sold to any other individual or entity. Notwithstanding the foregoing, Beginly may assign or transfer these Terms of Service and its relationship with any user, without such user's consent, in connection with a merger, acquisition, corporate reorganization, or sale of all or substantially all of Beginly's assets.
Governing Law
These terms are governed by and construed in accordance with the laws of Oregon, USA. Any disputes arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Oregon, USA.
